Pedestrian Accidents and Injuries

You Need Strong Representation After an Accident

Accidents with pedestrians are particularly dangerous given their vulnerability to injury. Many drivers do not respect pedestrians and often will not grant them the right of way. Missouri has several laws that pertain to pedestrians, and if you are a pedestrian injured in such an accident, you need to be aware of some of the laws that protect your interests. Ryan R. Cox & Associates, LLC, can provide you with the guidance you need.

Understanding Your Rights As A Pedestrian

In Missouri, when traffic control signals are not in place or not in operation, the driver of a vehicle shall yield the right of way, slowing down or stopping if necessary, to a pedestrian crossing the roadway within a crosswalk, to a pedestrian that is upon half of the roadway where the vehicle is traveling, or to a pedestrian that is approaching so closely from the opposite half of the roadway as to be in danger.

Pedestrians are required to yield to traffic when crossing a roadway at any point other than within a marked crosswalk or within an unmarked crosswalk in an intersection. The pedestrian is also required to yield to traffic when crossing a roadway at any point where a pedestrian tunnel or overhead pedestrian crossing has been provided. Missouri Revised Statute 300.395 establishes areas in which pedestrians are prohibited from crossing.

Walking and running are popular activities that offer opportunities for exercise, relaxation, and enjoyment of the outdoors. Unfortunately, the volume of traffic on America’s roads can spell trouble for pedestrians. Clearly, a person on foot has no protection against the speed and weight of a motor vehicle. Because of their vulnerability, pedestrians are at risk for serious injury or loss of life if drivers are careless, inattentive or negligent. Latest figures from the U.S. Department of Transportation indicate that more than 60,000 pedestrian were injured in traffic accidents in 2021, an 11 percent increase form 2020.

Cox & Associates that the injuries pedestrians suffer are likely to be severe ones. The Insurance Institute for Highway Safety explains that many variables may be involved in such a collision, but that “most pedestrians are struck by the front of a passenger vehicle.” Our personal injury attorneys know this means that pedestrians hit car bumpers, hoods, and windshields – all hard surfaces capable of breaking bones, causing severe head wounds, and damaging internal organs. When you’re badly hurt because of a motorist’s carelessness, you want an attorney who will fight for the monetary damages you need to pay for doctors, hospitals, physical therapists, medications, adaptive equipment, and other treatment necessities.
